These Terms & Conditions (“Terms”) form a binding agreement between you and HomeNetworks (“HomeNetworks,” “we,” “us,” or “our”) and govern your purchase and use of our residential fiber broadband service, leased equipment, mobile and web applications, the network monitoring dashboard, and our website (collectively, the “Services”) in the United States. By ordering, activating, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and Account
You must be at least 18 years old, a U.S. resident, and the owner or authorized occupant of the service address to subscribe. You agree to provide accurate, current, and complete account information and to keep it updated. You are responsible for activity on your account, including use by household members and guests, and for keeping your credentials confidential.
2. Service Description
HomeNetworks provides fiber-speed residential broadband with real-time network monitoring. Advertised speeds are maximums and are not guaranteed; actual speeds depend on your plan, equipment, in-home wiring, Wi-Fi conditions, device capabilities, network congestion, and the destination of the traffic. Service is provided on a best-efforts basis and may be temporarily unavailable due to maintenance, upgrades, outages, or events outside our control.
3. Trial Offer
If you sign up under our trial offer, the following apply in addition to these Terms:
- No installation fee for standard residential installations during the promotional period. Custom or non-standard installation work may incur additional charges, which will be disclosed before they are incurred.
- Cancel anytime during the trial without an early termination fee. You remain responsible for any usage charges, taxes, and the return of leased equipment.
- The trial covers the broadband plan you selected at signup. Add-on services and third-party charges are not included.
- We reserve the right to modify or end trial promotions for new orders at any time. Existing trial enrollments will be honored under the terms in effect when you subscribed.
4. Plans, Pricing, Billing, and Taxes
Current plans and pricing are shown on our website. Recurring charges are billed monthly in advance to the payment method on file. Usage-based charges (if any) are billed in arrears. Prices exclude applicable federal, state, and local taxes, surcharges, and regulatory fees, which will be added to your bill. We may change prices and fees with at least 30 days’ notice (or as otherwise required by law); your continued use of the Services after the effective date constitutes acceptance.
Late or unpaid balances may incur a late fee permitted by applicable law and may result in suspension or termination of Services. Disputed charges must be raised within 60 days of the bill date.
5. Cancellation and Termination
You may cancel your Services at any time through your account dashboard or by contacting customer support. Service will end at the conclusion of the current billing cycle unless you request immediate disconnection. We may suspend or terminate Services for non-payment, breach of these Terms, fraud, abuse of the network, or as required by law.
Upon termination, you must return all leased equipment within 30 days in good working condition (normal wear and tear excepted). Unreturned or damaged equipment will be billed at the replacement cost listed on our website.
6. Equipment and Installation
We may provide a router, optical network terminal (ONT), or other equipment to deliver the Services. Leased equipment remains the property of HomeNetworks. You agree to:
- Use the equipment only for the Services and in accordance with our instructions.
- Allow our technicians reasonable access to your premises for installation, maintenance, and removal.
- Not modify, resell, relocate to another address, or tamper with the equipment.
- Be responsible for loss or damage caused by misuse, neglect, or unauthorized access.
You are responsible for inside wiring, electrical service, and any devices you connect to the network.
7. Acceptable Use
You agree not to use the Services to:
- Violate any applicable U.S. federal, state, or local law or regulation.
- Infringe intellectual property or other rights of any third party (including violations of the Digital Millennium Copyright Act).
- Send spam, phishing, malware, or conduct denial-of-service attacks.
- Resell or redistribute the Services or share them outside your residence without our written consent.
- Operate a commercial server or hosting business on a residential plan.
- Interfere with the network, our customers, or our equipment, or attempt to gain unauthorized access to any system.
We may apply reasonable network management practices consistent with FCC requirements to protect the integrity, performance, and security of the network. Repeated or material violations may result in suspension or termination.
8. Network Monitoring Dashboard
The network monitoring dashboard provides real-time information about your in-home network, such as connected devices, bandwidth usage, and connection quality. The dashboard is provided for informational and diagnostic purposes. You are responsible for the accuracy of any device names or labels you add and for sharing dashboard access only with members of your household.
9. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share personal information, including Customer Proprietary Network Information (CPNI) under Section 222 of the Communications Act.
10. 911 / E911 Service
HomeNetworks provides broadband internet access. Any voice service you use over the connection (such as VoIP from a third party) may have 911 limitations, including during power or network outages. You are responsible for understanding the 911 capabilities of any voice service you use.
11. Intellectual Property
All content, software, trademarks, and materials provided as part of the Services are owned by HomeNetworks or its licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use them solely to access the Services. You may not copy, modify, reverse-engineer, or create derivative works except as permitted by law.
12. Disclaimers
THE SERVICES, EQUIPMENT, AND DASHBOARD ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, HOMENETWORKS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMENETWORKS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND VENDORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO HOMENETWORKS FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PORTIONS OF THIS SECTION MAY NOT APPLY TO YOU.
14. Indemnification
You agree to indemnify and hold harmless HomeNetworks and its affiliates from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
15. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights.
Except for small-claims matters or claims for injunctive relief related to intellectual property, you and HomeNetworks agree to resolve any dispute arising out of or relating to these Terms or the Services through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in the U.S. county of your billing address or another mutually agreed location, and may be conducted by phone or video where appropriate.
Class action waiver. You and HomeNetworks agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative action.
Opt-out. You may opt out of this arbitration agreement by sending written notice to the address in Section 19 within 30 days of first agreeing to these Terms.
16. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs Section 15. To the extent any dispute is not subject to arbitration, it will be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the revised Terms on our website, update the “Last Updated” date, and, where required, provide notice by email or through your account at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
18. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce a right is not a waiver of that right. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy and any order or service-specific addenda, are the entire agreement between you and HomeNetworks regarding the Services.
